1. Acceptance and scope
This User Agreement applies to the PicMark iOS app and related services. Please read it together with the Privacy Policy. By selecting “Agree and Continue” or using PicMark, you agree to these terms. If you do not agree, do not use the app.
2. PicMark services
PicMark provides on-device image recognition, redaction, annotation, stitching, batch processing, export, optional subscriptions, and optional Cloud Space features. Core image recognition and editing run locally by default. Features may vary by app version, device, region, and subscription status.
3. Eligibility and accounts
You must have the legal capacity required in your region. Minors should use account, cloud, purchase, or advertising features only with a guardian's consent and guidance. If you create an account, provide accurate information, protect your credentials, and promptly notify us of unauthorized access.
4. Your content and Cloud Space
You retain ownership of images, projects, annotations, and other content you create or import. When you explicitly upload content to Cloud Space, you grant us only the limited permission necessary to store, transmit, process, display, synchronize, back up, and return that content for the service. This permission ends when the content is deleted, subject to reasonable backup cycles and legal obligations.
You are responsible for having the rights and permissions needed for content you process, upload, or share, including images of other people, copyrighted material, and personal information.
5. Acceptable use
Do not use PicMark to violate law or others' rights; create, store, or distribute illegal or seriously harmful content; impersonate others or commit fraud; bypass security or usage limits; introduce malicious code; disrupt the service; reverse engineer protected service components except where law permits; or use automated means that create unreasonable load.
6. Subscriptions and purchases
PicMark Premium purchases are processed by Apple App Store and StoreKit. Prices, trial eligibility, billing period, taxes, renewal, cancellation, and refunds are governed by the purchase screen, your App Store region, and Apple's rules. Auto-renewable subscriptions renew unless canceled through Apple at least 24 hours before the current period ends. Deleting the app does not cancel a subscription.
7. Third-party services
Some versions may use Apple, Google, Pangle, Tencent, AppLovin, Cloudflare, or other providers for platform services, analytics, advertising, delivery, storage, authentication, security, and support. Third-party services are governed by their own terms and privacy policies. This Agreement supplements the Apple Standard EULA; where applicable law or Apple's mandatory terms prevail, those rules control.
8. Intellectual property
PicMark's software, interface, brand, documentation, and service content are protected by intellectual-property laws. Except for the limited, revocable, non-transferable right to use the app for its intended purpose, no rights are granted to PicMark intellectual property. Feedback may be used to improve the product without restriction or payment.
9. Availability and responsibility
We work to keep PicMark secure and reliable, but services are provided to the extent permitted by law without guarantees of uninterrupted availability, perfect recognition accuracy, permanent cloud storage, or suitability for every purpose. Review redactions and exports before sharing them. Keep independent backups of important content. Nothing in this Agreement excludes rights or liabilities that cannot lawfully be excluded.
10. Suspension and termination
You may stop using PicMark at any time and may delete local or cloud content through available features. We may restrict or terminate access when reasonably necessary for security, legal compliance, service protection, nonpayment, or a serious or repeated breach. Where appropriate, we will provide notice and a reasonable opportunity to resolve the issue.
11. Changes, law, and contact
We may update these terms when services or legal requirements change. Material changes will be notified as required, and renewed agreement will be requested where necessary. This Agreement is governed by applicable law. Disputes should first be addressed through good-faith consultation and otherwise handled by a court or authority with lawful jurisdiction.
